The Cassation Criminal Court will analyse, as a part of the Supreme Court, the information sent by the “Uspishna Varta” human rights platform concerning the use of the “Mirotvorets” website as evidence by the courts of Ukraine. The results of the analysis will resolve the issue of the appropriateness of conducting an appropriate generalization of judicial practice.
On March 26th, 2019 the Shevchenkovsky district court of Kiev satisfied the complaint of the human rights platform "Uspishna Varta" about the inactivity of the State Bureau of Investigations (SBI) in the investigation into the "Mirotvorets" website. The court ordered the authorized persons of the SBI to enter information about an offense committed by law enforcement officers in collusion with the Director of the "Mirotvorets" center Roman Zaitsev into the Unified Register of Pre-trial Investigations (URPI) and start a pre-trial investigation.
In April, 2019 “Uspishna Varta”, through the court, ordered the State Bureau of Investigation (SBI) to investigate the crime committed by the “Mirotvorets” website in collusion with law enforcement bodies when it published the personal data of the “Klymenko Time” YouTube channel journalist Maksim Osovsky on its website. This happened after a journalist filmed a report about the picketing of the Presidential Administration by “activists” of the “National Corpus” group on March 9th. On April 12th the Shevchenkovsky District Court decided to oblige the authorized persons of the SBI to enter information about the crime into the Unified Register of Pre-trial Investigations and start a pre-trial investigation.
On July 10th, 2019 it became known that the personal information of the journalist of the YouTube channel “Klymenko Time” was removed from the “Mirotvorets” online resource. However, it isn’t yet known who transmitted and published the personal data of the journalist, when it was done, and under what circumstances it happened. The human rights activists of “Uspishna Varta” insist on further investigating the crime committed by “Mirotvorets” in relation to the journalist, as well as other numerous facts of people’s personal data being entered into the website without their consent.
