The Dolinsky court once again sent the indictment in the case of Ruslan Kotsaba back to the Prosecutor

On January 21st the Dolinsky district court of the Ivano-Frankovsk region returned to the prosecutor the indictment concerning the case of the journalist Ruslan Kotsaba, who is accused of state treason and disrupting mobilisation according to Part 1 of Article 111 and Part 1 of Article 114-1 of the Criminal Code of Ukraine.

The collegium of judges made the decision to return the indictment against Ruslan Kotsaba to the prosecutor for revision, since the court established a significant number of violations committed by the pre-trial investigation body, namely the lack of accurate formulations concerning the commission of a criminal offense.

Ruslan Kotsaba's case is being continuously monitored by the "Uspishna Varta" human rights platform.

As a reminder, the journalist Ruslan Kotsaba was arrested by the staff of the SBU on February 7th 2015. He was accused of state treason and disrupting mobilisation. Ruslan Kotsaba spent 524 days in a pre-trial detention center. In the spring of 2016 the court sentenced him to 3.5 years of imprisonment, but in the summer, on July 14th 2016, the Court of Appeal completely acquitted and released the journalist. Nevertheless, on March 30th 2017 the prosecutor's office filed an appeal and the Supreme Court returned the case to the Court of Appeal for reconsideration. On July 11th 2018 the Court of Appeal of the Lvov region published a ruling that upheld the acquittal verdict of the Dolinsky court of the Ivano-Frankovsk region.
