The court hearing concerning the case of Vasilets and Timonin was postponed to February 15th

On February 1st the Vasilkovsky city district court of the Kiev region postponed the hearing on the case of the journalists Vasilets and Timonin due to the lack of lawyers for the accused.

Human rights activists note that the date of the most recent hearing concerning the case of Vasilets-Timonin was appointed in violation of procedure.

According to the lawyer Elena Leshenko, part 8 of article 135 of the Criminal Procedure Code of Ukraine, according to which the court must notify the defence three days before the scheduled hearing, was violated. Instead, the lawyer was notified only on January 31st. And the court hearing, as we remember, was supposed to take place on February 1st.

The defence filed a motion asking to postpone the hearing and notify the lawyers subject to the requirements of article 135 of the Criminal Procedure Code.

In addition, the accused were not notified about the scheduled hearing.

"About an hour ago I incidentally find out that I have a scheduled court hearing tomorrow at 10.00 in Vasilkov concerning the case that was fabricated against us by the SBU. I didn’t receive either a summons, a notification, or even a little SMS, but a hearing was appointed, in violation of all procedures," wrote Dmitry Vasilets on his Facebook page.

As was previously reported by the human rights activists of "Uspishna Varta" on Telegram, on December 13th the Kiev court of appeal overturned the decision of the Borodyansky court of the Kiev region and satisfied the motion of the Zhytomyr Prosecutor's office, and thus returned the case to the court of first instance.

As a reminder, Dmitry Vasilets and Evgeny Timonin were detained by the SBU on November 24th 2015 on charges under article 258-3 of the Criminal Code of Ukraine - rendering informational assistance to terrorism – because of a 4-day trip to Donetsk in July 2014. They spent 2 years and 3 months in custody in a pre-trial detention center. On September 29th 2017 the Andrushevsky district court of the Zhytomyr region issued a guilty verdict and sentenced them to 9 years in prison, which was cancelled by the court of appeal, and the measure of restraint was changed to house arrest.

The case of Dmitry Vasilets and Evgeny Timonin is being constantly monitored by the "Uspishna Varta" human rights platform.
