NewsOne Journalist Attacked During Clashes Near the Prosecutor-General's Office in Kiev

A journalist of NewsOne TV channel was attacked while on air covering the storming of the Prosecutor-General's Office of Ukraine by representatives of C14, Bratstvo and Natsionalny Korpus right-wing organizations.

A NewsOne host who watched the attack from the studio immediately requested the law enforcement agencies to investigate the attack.

Uspishna Varta human rights platform lawyers believe that the incident may be prosecuted under Article 171 of the Criminal Code of Ukraine (Prevention of Legitimate Professional Activity of a Journalist) and Article 345-1 of the Criminal Code of Ukraine (Deliberate Battery of a Journalist in Connection with Professional Activity).

According to Sergei Tomilenko, Chair of the National Union of Journalists of Ukraine, none of the dozens of policemen at the site rushed to protect the journalist. "We see clearly the results of calls by irresponsible Ukrainian politicians. First, officials and their supporters divide the journalists into categories, and then they call for the deprivation of rights of "wrong" journalists. These threats and hostility provoke radicals' aggression and physical violence", Sergei Tomilenko commented.

Artem Shevchenko, Head of Communications Directorate at the Ukrainian Ministry of Interior, refused to comment on the attack against NewsOne journalist "because of the channel's editorial policy". "As a representative of the Ministry of Interior of Ukraine, I consider it unacceptable for an official to talk to a media that pursues openly anti-state informational policy", Mr. Shevchenko said. He added that "NewsOne TV channel pursues openly anti-Ukrainian policy, therefore, he cannot talk to them".

Andrey Portnov, General Manager of NewsOne, reacted to the incident at his Facebook page: "Today's battery of a NewsOne journalist right next to the Prosecutor-General's headquarters with approving inaction of the police will be included into all the international reports and brought through all the judicial procedures. While we realize that the culprits and the government officials are one and the same, now we'll prepare all the legal and international documents to bring the perpetrators to justice in the future. We'll not let it go".

It should be reminded that the right to freedom of speech and opinion is enshrined in Article 34 of the Constitution of Ukraine, as well as in Article 10 of the European Convention for the Protection of Human Rights and Fundamental Freedoms and Article 19 of the International Covenant on Civil and Political Rights, ratified by Ukraine. The Prosecutor's Office and the National Police must take maximum efforts to investigate the attacks against journalists promptly and efficiently; these attacks may be deemed as interference with legitimate professional activity of the journalists.
