The Prosecutor-General of Ukraine carried out searches at the home and office of Kirill Vyshinsky’s lawyer

On January 17th the staff of the Prosecutor-General of Ukraine carried out searches at the home of the lawyer Andrey Domansky, who acts on the side of the defence in a number of resonant criminal cases, including the case of the editor-in-chief of "RIA Novosti Ukraine" Kirill Vyshinsky.

Investigative actions took place in the house and office of the lawyer while Domansky himself was in Kherson at a hearing on the case of Vyshinsky. Investigative activities also took place at the home of the lawyer’s assistant.

"Today in Kherson the case concerning the extension of the term of detention imposed on Kirill Vyshinsky is being heard. I am now in Kherson, where I am getting acquainted with the materials of criminal proceedings. I am not in Kiev, that’s why it was decided to carry out searches on January 17th," wrote the lawyer on his Facebook page.

Domansky said that the ruling for the searches was issued by the Pechersky district court at the request of the Prosecutor General. And the cause of the investigation was a case in 2015 - the explosions near the Parliament during meetings in late August - in which he acted as a lawyer. According to the lawyer, the grounds for conducting searches are formal.

At the same time, the Press Secretary of the Prosecutor General Larisa Sargan said that the searches are taking place concerning a case in 2013. "Proceedings were launched upon the facts of the alienation of assets by the privatization of municipal property at a reduced price. The searches continue at three locations. Information will be available after they have finished. The searches were authorised by the court," said Sargan.

Andrey Domansky links these investigative actions primarily with public speeches at international venues, where he repeatedly stated that freedom of speech in Ukraine was being put under pressure. "I was warned by some law enforcement bodies that I will pay the price. I understand that I am paying, " said the lawyer.

In addition, according to Domansky, the carrying of searches is linked with his professional activity. Namely with his defence of the editor-in-chief of "RIA Novosti Ukraine" Kirill Vyshinsky, the leader of OUN Nikolay Kokhanovsky, and also with the cases of journalists deported from Ukraine and other politically persecuted persons.

Searches took place in the presence of the Council of Lawyers of the Kiev region, which includes Andrey Domansky. According to the representative of the Committee for the Defence of the Rights of Advocacy of the Council of Lawyers of the Kiev region Vitaly Naum, they didn't record any violations during searches at Domansky’s place; nothing was confiscated during investigative actions.

Naum also added that investigative actions are taking place simultaneously at several homes of lawyers in Kiev and the Kiev region. They are being carried out by the Prosecutor-General’s Office and the SBU. Some of the searches have already been completed, others continue.

As it became known, in the evening of January 17th 2 more searches were carried out. One of them was held at another property of Vyshinsky's lawyer, and the second - at the home of his assistant's relatives.

According to Domansky, these searches were carried out in violation of the requirements of the current legislation, and he made a corresponding remark concerning this fact.

"The search of an apartment where a lawyer lives could only be done on the order of the Prosecutor General or his deputy, as was the case in the morning, but this search was authorised by the investigator of the Prosecutor General's office, which actually makes it illegal," commented Domansky.

Also the lawyer confirmed that during the searches documents relating to his lawyer activity were confiscated.

As was previously reported by the human rights activists of "Uspishna Varta" on Facebook, on January 17th another motion of the Prosecutor to extend the detention of the defendant of Andrey Domansky, the editor-in-chief of RIA "Novosti Ukraine" Kirill Vyshinsky, will be considered in the Kherson city court.
