Lawyer: the trial of the "Uspishna Kraina" party is politically motivated

On December 12th a regular hearing on the claim of the Ministry of Justice of Ukraine concerning the ban of the "Uspishna Kraina" political party took place in the district administrative court of the city of Kiev.

The court made the decision to include the honorary party leader Aleksandr Klimenko as a third party. The judge also satisfied the motion of the defence to transfer the court session to February 2019 so that lawyers can become acquainted with the case papers.

The lawyer Sergey Voychenko, commenting on the results of the court session, noted that the legal process against the “Uspishna Kraina” party is politically motivated.

"Once again, the current Ukrainian government shows that it does not want to enter into any dialogue with the people, but simply blocks the activities of its political opponents, who have an opposite position. Despite the fact that this position is aimed at improving the lives of people," said the lawyer Sergey Voychenko.

As a reminder, on December 7 employees of the third party to the process, which is represented by the Prosecutor General's Office and the SBU, did not attend the hearing. The judge decided to continue the hearing without the representative of the SBU and also, despite the protests of the Ministry of Justice, satisfied the motion of lawyers for the right to involve in the hearing on the case the written or oral statements of the leadership of the political council of the "Uspishna Kraina" party. According to lawyers, this decision complicates the task of the Ministry of Justice to liquidate the political party via a simplified procedure as a "legal unit".

As human rights activists from "Uspishna Varta" earlier reported on Telegram, on June 20 2018 the district administrative court of Kiev accepted the claim of the Ministry of Justice against the "Uspishna Kraina" political party for the prohibition (compulsory dissolution) of the party for consideration andinitiated proceedings No. 826/9174/18. The Prosecutor General’s Office and the Security Service of Ukraine were brought in as third parties. The claim of the Ministry of Justice is based on the letter of the Deputy Prosecutor-General and Chief Military Prosecutor Anatoly Matios, which the Ministry of Justice itself points out in the administrative lawsuit.
